Site Terms & Conditions. Applied to all bookings. By Booking via our website or with us directly (invoiced included), you are accepting all terms and conditions. 

 

It is reccomended that you take out holiday insurance to cover yourself in the event of illness or an event that prevents you from taking your holiday.

 

PLEASE NOTE - IF YOU USE A VOUCHER CODE FOR DATES WHERE IT IS NOT VALID, YOU WILL BE REFUNDED. 

 

If you make a booking in winter please plan appropriately for the road conditions, remember this is England and the weather can vary dramatically, however our accomodation is not affected by the weather and will run no matter the weather conditions even in rain and snow. Breaks Fold Farm is not liable for any road closures or delays. Please plan appropriately - we are not close by to shops, so plan on bringing supplies with you. You are welcome to book a shopping delivery, but you must be available and on site to accept it. 

You are only liable for a refund should we fail to open our accomodation. There will be NO refunds for guests arriving late / or not arriving due to but not limited to, poor weather, vehicle breakdowns, public transport, acts of god and anything covered in the Events Outside Our Control.

We may cancel the contract for the accomodation at any time as a result of an Event Outside Our Control, We will either, at our sole discretion, provide an alternative date for the accomodation (this may exclude selected dates) or, if this is not possible, refund these paid amounts to you.

 

1. Definitions

1.1   When the following words are used in these Terms and Conditions, this is what they will mean:
“Terms”: these terms and conditions.
“Campsite”, “We”, “Us”, “Our” "Glamping" "Accomodation": Breaks Fold Farm, West End, North Yorkshire, HG3 4BB.
“Website”: www.breaksfoldfarm.co.uk
“Booking”: a booking request submitted to Us via Our Website, email, phone, post or in person.
"Arrival Date": the date on which your booking commences and you are due to arrive at the site.
“Prices”: the cost of Our services as detailed on the Website.

 

2. Contract

2.1   These Terms and Our price list set out the entire agreement between you and Breaks Fold Farm for the supply of Our services to you. Only these Terms shall apply to Our contract with you.

2.2   Please check that the details in these Terms and your Booking are complete and accurate before you submit your Booking or confirm your booking.

2.3   By submitting a Booking or making a booking you are deemed to have accepted these Terms. This applies to all bookings. Through our web booking system, onsite (card or cash) or invoiced.

2.4   We reserve the right to change these Terms including terms related to any new policies on the main camping page at any time and any such changes will take effect immediately when posted on the Website, at the Campsite, or otherwise brought to your attention.You are bound to this by booking.

2.5   In addition to these Terms, you must comply with the Rules below.

2.6 If you do not adhere to our Terms and rules or fail to pay for your accommodation, you will be in breach of your contract and will be made to leave. Legal action will be taken for unpaid invoices or cancellations without payment.

2.7 A booking can not be made for more than 28 days. A person or persons may not stay onsite for longer than 28 consecutive days.


2.8 These terms and conditions may change at any time and any new conditions or amendments will apply to your booking. 

2.9 By booking online, in person, by email or telephone you are agreeing to these terms and conditions, as an individual or company. 

 

3. Making a Booking

3.1   You can book online, via email, or in person.

3.2   Bookings are not transferable to another party.

3.3   When making a booking you agree that you or at least one member of your party is twenty one (21) years or over, you have the authority of all persons in your party to book on their behalf, you accept these Terms & Conditions and you agree to be responsible for any loss or damage caused by any member of your party.

3.4   Advance bookings may at times be subject to minimum stay periods. These vary by season and please refer to Our Website for further details.

3.5   The Campsite is to be used for recreational camping and caravanning only. All other accomodation is for recreational use only.

3.6  If you are part of a group booking of 8 people or over, you must phone us before making a booking otherwise you may be refused entry on arrival. We do not accept same sex groups without prior approval. Group bookings over and above our website booking system will be invoiced and accept the same ts and cs upon receipt of the invoice. 

3.7 A booking can be made for camping or shepherds huts as holiday accommodation only, for a maximum of 14 days via the website. Longer stays may be available, please contact us directly.

3.8 You must be able to provide proof of booking on arrival, either a printed confirmation or a screen shot on a mobile device if asked. 

 

4. Rules

You, together with all members of your party, are required to comply with the following rules:

4.1   We reserve the right of admission. We only accept responsible guests that are considerate to fellow campers/guests and be respectful of the environment.

4.2   All children must be closely supervised by an adult due to moving farm machinery and livestock nearby.

4.3   If you bring a dog, this remains your responsibility at all times, must be on a lead and not left unattended either on the campsite or in fixed accomodation. Dogs are limited to a maximum of 2 per party and will incur an additional charge, they must be exercised away from the main camping areas and accomodation gardens. You are responsible for any mess, which should be cleared up and disposed of immediately. You will be asked to put your dog on a lead if it is seen roaming free around the camping area or any other area on the farm. Large groups or site bookings, the availability of having dogs on site will be discussed prior and agreed on a seperate basis. We may not accept dogs depending on the location of livestock and the amount of people expected, as our animal welfare is our priority. Dogs must be kept on a lead at all times - absolutely no exceptions. You must comply with any laws relating to the breed of the dog. You will be asked to leave no refund if you have your dog off lead and/or are not complying with laws in force at the time of your visit or if your dog causes a nuisance to other guests or dogs onsite. 

4.4   There must be no loud or disrupting noise after 22:00 before 08:00. Children must not use the play area on the campsite between these hours out of respect for the other people staying onsite. Hot tubs are not be used between these times. The hot tubs may only be used by the booked guests who are booked into the relevant accomodation. 

4.5   The Campsite is a tent only area. All tents must be non-permanent. VW type, tent boxes, small vans with drive away awnings are accepted. Trailer tents are accepted on the campsite. We have other areas of the farm for caravans and motorhomes. We do accept bell tents with stoves, but all wood must be purchased from us due our clean air policy. If your unit doesn't fit these descriptions you must contact us prior to booking. 

4.6   Leave your accommodation as you found it, ie: no litter or damage. Ensure any bbqs are raised from the grass. You will be liable for any damages or excess cleaning caused to any of our property and will be charged. You will be notified via email of the chages and a breakdown and your payment card will be back charged to this amount. 

4.7   Music players/radios must be kept to a reasonable volume and then switched off by 22:00. We ask where possible that people use headphones.

4.8   No fireworks, drones, chinese lanterns, guns or weapons.

4.9   No hen/stag parties or weddings.

4.10  Drunk, disorderly or abusive behaviour will not be tolerated towards us or other guests. We reserve the right to ask you to leave immediately, no refund, should this occur.

4.11  We cannot accept responsibility for your possessions or any personal injury of any kind sustained while on Our land, subject to Section 8 - Liability. You must not stray into fields or buildings around the farm. This is for your own personal safety. 

4.12  No pitches are reserved and are allocated on a first come, first serve basis. Pitches are numbered on the campsite with clear signage showing how to pitch. If you pitch incorrectly you may be asked to move your tent/campervan.

4.13  No open fires are allowed. BBQs are permitted if raised off the ground to protect the grass and fire pits are available to hire from us and are brought around every evening. BBQs must not be used on the decking areas of the glamping and static caravan.

4.14  You are liable at all times for any fires, BBQs and other activities undertaken around the site. We do not allow open fire of any sort inside your tent/unit/awning due to the high risk of carbon monoxide poisoning. 

4.15   Whilst on Our land, you and any members of your party must not enter any buildings apart for the toilet/shower block, or climb over any dry stone walls, fences or barriers. You and your party will be liable for any damage caused.

4.16   Any accidents on Our land must be reported at the farm house or a member of staff so we can log them in Our Accident Book.

4.17 Check in is not before 14:00, you may be liable to a fee of £10 if you arrive before this time or you may be asked to leave and come back at 14:00. You must vacate your chosen accommodation by 10:00 on your departure day promptly, unless a late check out has been granted by prior agreement, please ask the site management. 11:30 for Camping.

* Check is from 3pm for all other accomodation (Early Check In / Late Check Out may be available but there is a fee for this depending on you request, from £20)

4.18 You must keep to the 5mph speed limit on our farm and site for your own and others safety.

4.19 You must take large items of rubbish away with you i.e. broken, tents, cardboard, airbeds, bbqs, chairs etc. Only general food waste and packaging is to be disposed of in our bins. You may be liable to a minimum £40 charge if we end up having to dispose of bulky items.

4.20 We do not offer any sort of storage facility for caravans or tents. If you do leave your property on our site, we will make reasonable attempts to contact you and after 21 days, if no contact has been made, it will be sold and we will take the value of storage costs from the sale.

4.21 You must leave a gap of 6m between all units. This is a legal requirement. You may be asked to move your tent/unit if pitched too close to another. 3m is acceptable for agreed groups booked together. We have provision for 30 units (tent, campevan).

4.22 No Day Guests unless by prior arrangement. 

4.23 If you plan on arriving back on site after 22:00, you must please park your vehicle opposite the stables or near the facilities blocks as to not disturb other guests on site.

4.24 Please note if you have booked multiple services we have maximum numbers of people we allow in each facility due to fire safety and health and safety regulations. For the static caravan this is 4 people only. For the holiday cottage 6 people. For the shepherds huts this is 2 people. You will be asked to leave if these guidelines are not adhered to. 1 car is included with each accomodation booked, extra cars will be asked to park in late parking and are chargable per night. 

4.25 We reserve the right to back charge your payment method for any damages or disturbance to other guests on site. This will be a minimum of £50. Any damages should be discussed with us and we will come to an appropriate charge. Excess cleaning will also be billed at a minimum of £50 and then subsequently charged at £15 per hour there after or to the value of the damaged item, should you leave any accomodation in an unsatisfactory state. You will be notified by email on the one given when you booked. If you notify us at the time we will discuss with you whether the damage is payable.

4.26 You must not smoke around the farm yard or near any of the livestock areas as the farm is a work place. 

4.27 We reserve the right to suspend the use of charcoal bbqs (including disposable) and firepits without notice in cases of extreme hot/dry weather. Always plan an alternative to bbq in prolonged spells of hot weather, as it is highly likely that we will place a fire ban on site to protect our guests and the surrounding woodland/farmland. 

4.28 No paddling pools, swimming pools, slides, hot tubs (unless booked with our accomodation), water balloons are allowed on any part of the site.

4.29 Only firepits and wood purchased from us may be used on our campsite and in our firepits. We use a special type of compressed logs to adhere to clean air policies and for safety reasons. 

4.30 In the event of poor/wet weather we will reduced vehicle movment on the camping field.You may be asked to park your or your party's vehicle(s) off the field. 

4.31 Please note that wild swimming/kayaking/boating/paddle boarding or any type of water sports are not permitted on the neighbouring reservoir (thruscross). Reservoirs are extremely dangerous, very deep and unpredictable bodies of water and you are putting yourself at very high risk by doing any of the non permitted activities. Refer to Yorkshire Water's website to whom this area belongs. No liablility will be taken by us Breaks Fold Farm, to those that do not heed this warning. 

 

5. Prices

5.1   The prices are based on a nightly rate unless otherwise stated. Prices include VAT at the current prevailing rate of 20%.

5.2   Whilst we will make every effort to ensure that our prices remain unchanged, they may be amended at any time.

5.3   Prices do not include any additional services, features and facilities unless expressly stated. These are charged on a seperate basis.

5.4   Promotions, deals or discounted offers are subject to availability and cannot be used in conjunction with any other offer or discount and may be withdrawn at any time. Retrospective refunds are not permitted against any offer or promotion advertised after such time a booking is made.

5.5 Minimum stays do apply to certain accomodation, please check the calendar on the chosen accomodation.

 

6. Payment

6.1   Credit or debit card payments are preferred in advance of arrival and online. Cash is accepted onsite in person. If the booking was not made online then we accept payment by credit or debit card or cash on arrival. Pre-payment is advised to reserve your booking, as we cannot guarantee availability to 'walk in' customers. BACS transfer, cash in advance or card payment are accepted for invoiced bookings. 

6.2 Non-payment does not release you from the agreed contract and you will still be subject for monies owed as per our cancellation policy 7. If you are present onsite and refuse to pay, entry will not be given and you will be asked to leave. 

6.3 For fixed accomodation we only accept pre-booked, pre-payed guests.

 

7. Cancellation, refunds and amendments to your booking

7.1   30 days or more before the booking date 100% refund (less card fees - we are not refunded these if you cancel) or free rebooking, subject to availability. Rebookings are not carried over intot the new season/year. 

7.2   29 - 14  days prior to booking 50% refund or (camping only rebook for no charge (subject to availability)). (We can offer 8.0 at our descretion. See below). Within 14 days, no refund fixed accomodation (Shepherds huts) - 7.2a will be attempted before a final decision is made) - (rebooking for camping may be offered if available, but will be offered at off peak times - midweek or off peak weekends, within the current season - this does not apply to large group bookings i.e. D of E, whole site bookings). Rebookings are not carried over into the new season/year.

7.2a  For fixed accomodation (shepherds huts) a full refund less an admin charge of £20 + credit card fees will be offered if you booking can be filled at any time - we will do our best to refill your dates via our advertising channels. If the booking cannot be filled, then no refund will be given within 14 days of the booked date. Please note if booked via an OTA site (airbnb etc) this cannot be offered, and we are bound by their policies. 

7.3   You may cancel your booking at any time and your booking will be treated with 7.1 or 7.2 (a) of our booking policy.

7.4   The full balance of your booking must be paid in full before arrival or pitching (camping) or by the date on an invoice if a group booking. Or paid on arrival if you are a walk in customer - cash or card accepted.

7.5   A booking can only be amended once i.e. a date change - provided good time is given. 

7.6   No booking amendments will be accepted by Us within the 7 days prior to your Arrival Date. (We can offer 8.0 at our descretion. See below).

7.7  We do not accept poor weather as a reason for cancellation/rebooking, unless it is deemed as unsafe and risk to public safety i.e. flooding, hurricanes and other extreme weather conditions in which case you will be contacted and offered an alternative date. 

7.8  If you have a problem onsite, you must speak to us face to face to allow us chance to rectify the problem - we will not accept an email complaint or threat of poor review without first telling us onsite. All complaints must in the first instance be done face to face, to give us reasonable a time frame to rectify the problem and then put in writing should you wish to. If the problem you have had cannot be rectified at your time of stay, within a reasonable time time-frame, you will be compensed a partial or full amount dependant on the issue. If a bad review is threatened just to gain compensation and followed through with, legal action will be taken.

7.9 Bookings are not transferrable to another party without prior approval. Please email us to advise if a different party is taking your place, with a name, addess, email address, contact number and car registration. You must not advertise dates or accomodation for sale online or otherwise - we will do this on your behalf via 7.2a of this cancellation policy. If you are purchasing as a gift please input the recipients details onto the booking. We do also sell gift vouchers. Please email us if you require assistance with this. 

8.0 Other cancellations and amendments are at our descretion. 

Cancellations take up our time as a business and cost us in fees via our payment system hence why we have a cancellation policy in place that is deemed to be fair to both us as a business and you as the customer. By booking and then cancelling, it has prevented another potential customer from booking the dates you have booked. We always work hard to fill any cancellations to try and be fair to the customer. It is reccomended you take out travel insurance as you would with any abroad holiday. Cancellations or date amendments within 48 hours of arrival are not providing us with reasonable notice and will not be refunded or moved - only in exceptional circumstances will be treated with 8.0. We reccomend event insurance for group bookings. The cancellation policy applies to all bookings made - on the website, in person, via phone or via email. By booking by any means you are accepting our cancellation policy. 

 

8. Liability

Please read this section as it is important that you understand what you are agreeing to.

8.1   Nothing in this section limits or attempts to limit our liability for death or personal injury caused by Our negligence or for fraud or fraudulent misrepresentation, or for any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude Our liability.

8.2   If we fail to comply with these Terms we are responsible for loss or damage you suffer that is a direct and foreseeable result of Our failure or Our negligence.  We shall not be responsible for any losses that you suffer that are indirect or not foreseeable, including, but not limited to, loss of income or revenue, loss of business and loss of anticipated savings.

8.3   Where we are responsible for your loss of equipment or personal belongings, Our maximum liability shall be no more than to refund the amount paid by you for the holiday.

8.4   As Our Farm is located in a rural environment, we do not accept responsibility for any damage, injury or inconvenience caused by livestock, plants, trees, wildlife or weather. We advise you to have the relevant insurance.

8.5   Should any of the vehicles owned by your party get stuck and require assistance or towing, we shall not be held responsible for any damage caused to the vehicle(s). You should check that your insurance cover will allow secondary towing. There may be a charge for this service.

8.6   We do not accept responsibility for anything that adversely affects your holiday that is outside of Our control. We advise you to have suitable travel insurance.

8.7   These Terms are governed by the laws of England and Wales.

8.8  We are covered by up to date Public Liability Insurance and hold the proper license through Freedom Camping Club for our campsite, cl and glamping.

 

9. GDPR

9.1  Your data is stored securely and is only used with regards to your booking. Your information will never be passed onto a 3rd party. If you receive an email from us and do not wish to be on our mailing list you can opt out at any time. Payment details are not stored or seen by us and are only used for the purpose of you creating a booking through Stripe. We hold a copy of the 2016 GDPR policy which you are welcome to view.
